Do I need a permit?
Moving Permits
Any person moving in, out, or within Upper Nazareth Township must obtain a moving permit in order to comply with Township Code of Ordinances Adopted and Revised June 16, 2021. Permits can be obtained at the Upper Nazareth Municipal building for a fee of $10.00.
Building Permits
Regulations for the Uniform Construction Code are being updated and changed continually. Permits are required for above-ground/in-ground pools greater than 24” in depth including blow up pools, additions, basements, road openings, electric, sheds, fences, demolition, driveways, decks, signage, new construction, chimneys, sewer/septic, just to name a few. If you have any questions about permits and before doing any type of construction, it is advised that you contact the Zoning/BCO Officer at 610-759-5341 ext. 204 to find out the current requirements. Permits are not required for re-roofing existing roofs where there are no structural changes, exterior siding and/or window replacements where items are replaced in kind. Fees are calculated by the cost and size of the project. All residential home improvement contractors are required to be licensed by the state. It is recommended that you ask your home improvement contractor for their state certification number. It is also your responsibility to check property/lot deed restrictions before signing permit applications.
Pool Permits
A permit is required for any structure intended for swimming or recreational bathing that contains over 24 inches or more of water (this includes blow up pools, in-ground pools, above-ground pools, and on-ground swimming pools, hot tubs and spas). A fence or similar enclosure surrounding the pool is necessary for pools/hot tubs/spas 48 inches and below. A fence shall extend not less than 4 feet above the ground and not more than 6 feet above the ground. A separate permit is necessary for a fence. All gates shall be self-closing and self-latching, with latches placed at least 4 feet above the ground. Raised decking of a swimming pool shall be a setback of a minimum of 10 feet from side and rear lot lines. An inspection by a third party inspector will be required to comply with the Uniform Construction Code Appendix G and the Upper Nazareth Zoning Ordinance. In-Ground Pool Permits require an Engineered Grading Plan.
